EB-3 I-140 Approval for Chinese Designer Beneficiary and Architecture Company Petitioner in Cleveland Ohio

Our client is from China. His current employer was willing to do an immigration petition for him. Our client has a Bachelor’s degree in Architecture. Our firm concluded that his employer can petition him as an Architectural Designer. Our office determined that he is eligible for EB-3 classification. 

 

Before filing PERM, our firm prepared the prevailing wage request and all other steps that are important in pre-PERM filing. On November 16, 2021, the request was filed.  After we obtained the Prevailing Wage determination, our office filed it on June 2, 2022.  On August 26, 2022, we promptly filed PERM.  On June 21, 2023, the PERM Labor Certification was approved

 

We then proceeded with the I-140 Petition filing. We submitted the “ability to pay” letter for the I-140 application. We also included other necessary supporting documents.

 

The I-140 was filed on July 12, 2023, via regular processing service. On March 6, 2024, the USCIS issued the Request for Evidence letter and requested our client to submit any proof regarding his special skills that were listed in the PERM application. Our office filed the RFE on March 21, 2024, along with the letter from his previous employer. On April 11, 2024, the I-140 EB3 Petition for our Chinese client was approved. He can file an I-485 application for his green card once his priority dates become current.
