CASE: PERM Labor Certification
EMPLOYER: Public School District
BENEFICIARY: Filipino Sixth Grade Elementary Teacher in the Philippines
LOCATION: Bethune, CO
Our client has a prospective employer willing to petition for his third-preference petition (I-140).
Our client holds a Bachelor’s degree in Elementary Education, a valid Colorado teaching license,
and has worked in Colorado as an elementary teacher. Based on this educational and professional
background, our office determined that he is clearly eligible for the EB-3 classification.
Our client retained us in February 2024. Prior to filing the PERM application, our firm prepared
the prevailing wage request, job order, advertisements, internal job posting, recruitment report,
and all other essential pre-filing steps. Within a week of being retained, we filed the prevailing
wage request.
After obtaining the prevailing wage determination, the employer filed the job order on August
28, 2024. On November 18, 2024, we promptly filed the PERM application. On March 27, 2026,
the PERM Labor Certification was approved without an audit for this EB-3 position for the
Filipino beneficiary.
Once the PERM was certified, our client retained our office for his I-140 petition. We filed the I-
140 application via premium processing on May 14, 2026. On June 3, 2026, the I-140 was
approved without a Request for Evidence (RFE). Once his priority date becomes current, he can
file his immigrant visa application.
