Our client has a current employer that is willing to sponsor her for a third-preference petition (Form I-140). She holds a Bachelor’s degree in Elementary Education, possesses a valid South Dakota teaching license, and has worked for her current employer since August 2018. Based on her educational, professional, and employment background, our office determined that she is clearly eligible for an EB-3 classification for her I-140 petition. She ultimately retained our firm in February 2024.
Prior to filing the PERM application, our firm prepared the prevailing wage request, job order, advertisements, internal job posting, recruitment report, and all other essential pre-PERM filing steps. Note that the PERM application can be filed at least 60 days after the job posting date or 30 days after the last advertisement. Within a week of our retention, we filed the prevailing wage request. After obtaining the prevailing wage determination, her employer filed the job order on October 21, 2024. On February 18, 2025, we promptly filed the PERM application. Finally, on May 13, 2026, the PERM Labor Certification was approved without an audit for this EB-3 position for the Filipino beneficiary.
Once the PERM was certified, our client retained our office for her I-140 petition. We filed the Form I-140 via premium processing on June 24, 2026. On July 12, 2026, the I-140 was approved without a Request for Evidence (RFE). Once her priority date becomes current, she will be eligible to file her Form I-485 application for adjustment of status.
