H-1B Transfer Approved for Public School District and Filipina K2 Special Education Teacher in Lame Deer Montana

LOCATION: Lame Deer, MT

 

Our client is a public school district affiliated with several higher education institutions. In June 2026, the client contacted our office to seek legal assistance for one of its foreign national employees. The beneficiary, a native and citizen of the Philippines, holds a Master’s degree in Special Education. The offered position—a K-2 Special Education Teacher—qualifies as a specialty occupation, as it requires at least a Bachelor’s degree in Special Education or its equivalent.

 

The beneficiary previously held H-1B status through a former employer. Because her status had not yet expired, she sought to extend it through a change-of-employer petition.

 

Once retained, our office promptly prepared and submitted the H-1B petition with supporting documentation on July 13, 2026, requesting Premium Processing. As a change-of-employer petition, it was exempt from the annual H-1B cap. USCIS approved the petition without a Request for Evidence (RFE) on August 4, 2026. The beneficiary is now authorized to work for the petitioner for up to three years.
