CASE: H-1B Visa Extension Petition

Our client is a public school district in Saint Francis, SD. In July 2025, they contacted our office seeking legal assistance for an H-1B extension for a foreign employee. The beneficiary holds a master’s degree in special education and serves as a secondary school teacher. This position qualifies as a “specialty occupation” because it requires at least a bachelor’s degree in education or its equivalent. The beneficiary has worked for the client under H-1B status since November 2022.
Once retained, our office filed the H-1B petition with supporting documentation on October 2, 2025, via standard processing. On July 2, 2026, we submitted an I-907 premium processing upgrade request to USCIS. USCIS approved our client’s H-1B petition on July 23, 2026.
