EB-3 I-140 Approval for Filipino Third Grade Elementary Teacher Beneficiary and Public School District Petitioner in Saint Francis South Dakota

Our client‘s current employer was willing to petition him for an EB-3 third-preference immigrant visa (Form I-140). With a Bachelor’s degree in Elementary Education, a valid South Dakota teaching license, and continuous employment with his current employer since February 2022, our office determined that he clearly met the educational and professional requirements for EB-3 classification. The client officially retained our firm in February 2024.

 

Prior to filing the PERM labor certification, our firm completed all necessary pre-filing steps, including preparing the prevailing wage (PW) request, job order, advertisements, internal job posting, and recruitment report—ensuring compliance with the mandatory 30-to-60-day recruitment waiting periods. Within a week of being retained, we submitted the PW request. Upon receiving the PW determination, the employer placed the job order on August 26, 2024, and we promptly filed the PERM application on November 14, 2024. On March 25, 2026, the PERM Labor Certification was approved without an audit for the Filipino beneficiary.

 

Following PERM certification, the client retained us for the I-140 petition stage. We filed the I-140 petition via regular processing on May 12, 2026, and it was approved without a Request for Evidence (RFE) on August 5, 2026. The client is now prepared to file his Form I-485 Adjustment of Status application once his priority date becomes current.
