CASE: EB-3 I-140
EMPLOYER: Public School District
BENEFICIARY: Filipina 2nd Grade Elementary Teacher
LOCATION: Lame Deer, MT
Our client’s current employer was willing to petition her for a third-preference employment-based immigrant visa (I-140). Our client holds a Bachelor’s degree in Elementary Education, possesses a valid Montana teaching license, and has worked for her employer since September 2023. Based on her educational credentials and professional experience, our office determined that she was clearly eligible for EB-3 classification. She retained our services in September 2024.
Prior to filing the PERM application, our firm prepared the prevailing wage request, job order, advertisements, internal notice, recruitment report, and all other required pre-filing steps. Within a week of being retained, we filed the prevailing wage request. After receiving the determination, the employer placed the job order on April 15, 2025. On August 19, 2025, we filed the PERM application, which was approved without audit on July 24, 2026.
Following PERM certification, the client retained our office to handle her I-140 petition. We filed the petition with premium processing on September 21, 2026, and it was approved on October 14, 2026, without a Request for Evidence (RFE). Once her priority date becomes current, she will be eligible to file her Form I-485 application for adjustment of status.
