CASE: EB-3 I-140
EMPLOYER: Public School District
BENEFICIARY: Filipina Kindergarten Teacher
LOCATION: Lame Deer, MT
Our client’s employer was willing to petition for her under the Employment-Based Third Preference (EB-3) category. Holding a Bachelor’s degree in Elementary Education and a valid Montana teaching license, she has been employed with her current sponsor since August 2023. Based on her educational background and professional experience, our office determined that she clearly qualified for EB-3 classification, and she officially retained our services in September 2024.
Prior to filing the PERM labor certification, our firm prepared and completed all necessary recruitment steps, including the prevailing wage request, job order, mandatory advertisements, internal job posting, and recruitment report. Within one week of being retained, we submitted the prevailing wage request. Upon receiving the prevailing wage determination, the employer filed the job order on April 10, 2025. On August 15, 2025, we promptly submitted the PERM application, which was approved on July 24, 2026, without an audit—securing an EB-3 position for the beneficiary.
Following PERM certification, our client retained our firm to prepare her I-140 Immigrant Petition for Alien Worker. We filed the I-140 petition with Premium Processing on September 21, 2026. On October 14, 2026, the petition was approved without a Request for Evidence (RFE). As soon as her priority date becomes current, she will be eligible to file her Form I-485 application for adjustment of status.
