EB-3 I-140 Approval for Filipina Elementary Special Education Teacher Beneficiary and Public School District Petitioner in Lame Deer, Montana

CASE: EB-3 I-140

EMPLOYER: Public School District

BENEFICIARY: Filipina Elementary Special Education Teacher

LOCATION: Lame Deer, MT

Our client’s employer is willing to petition her for an employment-based third-preference (EB-3) Immigrant Petition for Alien Workers (Form I-140). She holds a Bachelor’s degree in Special Education, maintains a valid Montana teaching license, and has worked for her employer since August 2023. Based on her educational, professional, and employment background, our office determined that she clearly qualifies for EB-3 classification. She retained our firm in September 2024.

Prior to filing the PERM application, our firm completed all required pre-filing steps, including preparing the prevailing wage determination request, mandatory job order, advertisements, internal job postings, and recruitment report. Note that a PERM application may be filed no earlier than 60 days from the start of the job posting or 30 days from the final advertisement. Within a week of being retained, we submitted the prevailing wage request. After receiving the determination, the employer placed the job order on April 14, 2025. We filed the PERM application on August 20, 2025, and it was approved without audit on July 24, 2026—securing EB-3 certification for the beneficiary.

Following certification, our client retained us for the I-140 stage. We filed the Form I-140 with Premium Processing on September 24, 2026. The petition was approved on October 14, 2026, without a Request for Evidence (RFE). She will be eligible to file her Form I-485 Adjustment of Status once her priority date becomes current.
