Our client has a current employer who was willing to petition for her I-140 petition. Our client holds a Bachelor’s degree in Special Education, a valid South Dakota Teaching license, and has worked for her employer since January 2022. Based on our client’s professional and work background, our office determined that she is eligible for EB-3 classification for her I-140 petition. Our client eventually retained us in February 2023.
Prior to filing PERM, our firm prepared the prevailing wage request, advertisements, and all other important steps for pre-PERM filing. Within a week of retention, the prevailing wage request was filed. After obtaining the PW determination, her employer filed the job order on September 25, 2023. On January 23, 2024, we filed PERM.
On June 5, 2025, the PERM Labor Certification was approved – an EB-3 position for the Filipina beneficiary. The I-140 petition can be filed at any time.
