Our client has a current employer willing to petition for him under a third-preference (EB-3) petition (Form I-140). He holds a Bachelor’s degree in Teaching Mathematics, a valid South Dakota Teaching license, and has been with his current employer since August 2016. Based on his educational, professional, and work background, our office determined he is clearly eligible for EB-3 classification for his I-140 petition. Our client officially retained us in February 2023.
Before filing the PERM application, our firm prepared the prevailing wage request, job order, advertisements, internal job posting, recruitment report, and all other crucial pre-PERM filing steps. It’s worth noting that the PERM application can be filed at least 60 days from the job posting date or 30 days from the last advertisement. We filed the prevailing wage request within a week of being retained. After obtaining the prevailing wage determination, his employer filed the job order on September 18, 2023. We then promptly filed the PERM application on January 22, 2024.
Eventually, on June 5, 2025, the PERM Labor Certification was approved without any audit for an EB-3 position for the Filipino beneficiary. Our client can now file the I-140 petition at any time.
