CASE: I-485 EB-3
EMPLOYER: Public School District
BENEFICIARY: Filipina Elementary School Teacher
LOCATION: New Town, ND
Our client‘s current employer was willing to petition for an I-140. With a Bachelor’s degree in Elementary Education, a valid North Dakota Teaching license, and employment with her current employer since August 2018, our office determined she was clearly eligible for EB-3 classification for her I-140 petition. She retained us in February 2022.
Before filing PERM, our firm prepared the prevailing wage request, job order, advertisements, internal job posting, recruitment report, and all other necessary pre-PERM steps. The PERM application could be filed at least 60 days from the job posting date or 30 days from the last advertisement. Within a week of retention, we filed the prevailing wage request. After obtaining the PW determination, our office filed the job order on September 16, 2022. We promptly filed PERM on December 2, 2022. The PERM Labor Certification, for an EB-3 position for the Filipina beneficiary, was approved without audit on November 9, 2023.
Once PERM was certified, our client retained us for her I-140 petition. We filed the I-140 application via regular processing on December 18, 2023, including the job offer letter, notice of filing, and other necessary supporting documents. The I-140 was approved on May 23, 2024. Her I-485 adjustment of status application, filed concurrently with her I-140, was approved without any Request for Evidence (RFE) on May 23, 2025.
