Our client‘s current employer is sponsoring him for an EB-3 (third-preference) I-140 petition. Given our client’s educational background, which includes a Bachelor’s degree in Psychology and a valid South Dakota Teaching license (School Counseling), along with his work experience with the sponsoring employer, our office determined he was clearly eligible for EB-3 classification. He officially retained our services in April 2022.

PERM Labor Certification Process

Before filing the PERM application, our firm meticulously prepared all necessary pre-PERM documentation. This included the prevailing wage request, job order, advertisements, internal job posting, and the recruitment report. It’s important to note that the PERM application can be filed at least 60 days after the job posting date or 30 days from the last advertisement.

We filed the prevailing wage request within a week of retention. After receiving the prevailing wage determination, his employer filed the job order on March 2, 2023. We promptly filed the PERM application on June 29, 2023. Remarkably, the PERM Labor Certification for an EB-3 position for the Filipino beneficiary was approved without an audit on August 15, 2024.

I-140 Petition and Future Steps

Once the PERM was certified, our client retained our office to proceed with his I-140 petition. We filed the I-140 application via premium processing on December 16, 2024. The submission included the job offer letter, the notice of filing, and all other required supporting documents. The I-140 was approved on July 4, 2025. Our client can now file his I-485 adjustment of status application once his priority date becomes current.
