Our client‘s current employer is willing to file a third-preference petition (Form I-140) on her behalf. Our client has a Bachelor’s degree in High School ESL Teaching, a valid South Dakota Teaching license, and has worked for her employer since August 2019. Based on her professional, educational, and work history, we determined she is clearly eligible for EB-3 classification. She retained our services in May 2023.

 

Before we filed the PERM application, our firm prepared all the necessary pre-filing steps, including the prevailing wage request, job order, advertisements, internal job posting, and recruitment report. The PERM application could be filed at least 60 days after the job posting date, or 30 days after the final advertisement. The prevailing wage request was filed within a week of her retaining our firm. After we obtained the wage determination, her employer filed the job order on January 5, 2024. The PERM application was filed promptly on April 18, 2024.
