EB-3 I-140 Approval for Filipina Second Grade Elementary Teacher in Saint Francis South Dakota

Our client‘s current employer expressed a willingness to sponsor her for an EB-3 (third-preference) I-140 petition. She holds a Bachelor’s degree in Elementary Education, possesses a valid South Dakota Teaching license, and has been employed with her current sponsor since May 2018. Given her strong educational and professional background, our office confirmed her clear eligibility for the EB-3 classification. She officially retained our services in February 2023.

 

We immediately began the necessary pre-PERM procedures. This included preparing and filing the prevailing wage request (filed within a week of retention), the job order, all required advertisements, and the recruitment report. It’s important to note that the PERM application can only be filed at least 60 days after the initial job posting or 30 days after the final advertisement. Following receipt of the PW determination, her employer filed the job order on September 21, 2023. We proceeded to file the PERM application on January 19, 2024, and the Labor Certification was successfully approved without an audit on June 5, 2025, for the Filipina beneficiary’s EB-3 position.

 

With the certified PERM in hand, the client engaged our firm for the I-140 petition. We filed the application using premium processing on August 8, 2025. On August 25, 2025, USCIS issued a Request for Evidence (RFE), specifically requesting the client’s full academic transcript. We submitted our response on September 15, 2025, and the I-140 petition was approved shortly thereafter, on October 1, 2025. She is now positioned to file her I-485 Adjustment of Status application once her priority date becomes current.
