CASE: EB-3 I-140
EMPLOYER: Public School District
BENEFICIARY: Filipina High School ESL Teacher
LOCATION: St. Francis, SD
Our client‘s employer was willing to petition for an I-140. She holds a Bachelor’s degree in Teaching High School ESL and possesses a valid South Dakota Teaching license. She has been employed with her current employer since February 2022. Based on her educational and work background, our office determined she was eligible for EB-3 classification for her I-140 petition. Our client retained us in May 2023.
Before the PERM filing, our firm prepared the prevailing wage request, the job order, and all other necessary steps important for the pre-PERM filing stage. The prevailing wage request was filed within one week of our client’s retention. After obtaining the prevailing wage determination, her employer filed the job order on January 5, 2024. We subsequently filed the PERM application on April 18, 2024. The PERM Labor Certification was approved on August 12, 2025, for an EB-3 position for our Filipina client.
Once the PERM was certified, our client retained our office for her I-140 petition. We filed the I-140 application via premium processing on October 20, 2025. The I-140 was approved on October 29, 2025. Our client can now file her I-485 application once her priority date becomes current.
