CASE: H-1B Visa Petition

Our client, a public school district affiliated with several institutions of higher education, contacted our office in March 2025 seeking legal assistance for a foreign national they intended to employ as a High School Math Teacher from the Philippines. We demonstrated that this role is a “specialty occupation,” as it requires a Bachelor’s Degree in Education or its equivalent.
By the first week of April, the numerical cap for H-1B visas for fiscal year 2026 had been reached. However, our client qualified for a cap-exempt petition because it is a non-profit organization affiliated with an institution of higher education. After being retained, our office filed the H-1B petition with supporting documents via premium processing on May 6, 2025. The H-1B petition was approved on May 24, 2025.
