APPLICANT: Korean Pharmacist in Houston, TX
Our client, a pharmacist from South Korea on an H-1B visa, sought our representation for an immigration petition. With a Doctor of Pharmacy degree from the United States, our firm determined she was eligible for EB-2 classification, and her employer was willing to sponsor her.
PERM Labor Certification Process
Before filing PERM, we completed all necessary pre-filing steps. The prevailing wage request was filed on April 13, 2022, followed by the job order on November 9, 2022, after receiving the prevailing wage determination. We then filed the PERM application on January 23, 2023. The PERM Labor Certification for an EB-2 position was approved on February 28, 2024.
I-140 and I-485 Petitions
Subsequently, we filed the I-140 Petition on March 25, 2024, via regular processing. This included an “ability to pay” letter, the job offer letter, employer’s tax records, and other supporting documents. The I-140 EB-2 Petition for our client was approved on November 6, 2024. While the I-140 was pending, our office filed her I-485 application for a green card in July 2024. Her I-485 was approved by USCIS on May 22, 2025.
