EMPLOYER: Oral Surgery Group Petitioner in North Andover, MA
BENEFICIARY: Canadian Oral and Maxillofacial Surgeon
Our client is a Canadian citizen currently working in the United States as an oral and maxillofacial surgeon under H-1B status. His current employer is willing to file an immigration petition for him under the second preference (EB-2). Our client holds a Doctor of Dental Medicine degree from a U.S. institution and has completed a 4-year residency training program in Oral and Maxillofacial Surgery in the United States. After consulting with our client, our firm concluded that his employer can petition for him as an Oral and Maxillofacial Surgeon. Based on our client’s educational, professional, and work backgrounds, our office determined that he is clearly eligible for EB-2 classification.
Prior to filing the PERM labor certification application, our firm prepared the prevailing wage request, job order, advertisements, internal job posting, recruitment report, and all other necessary pre-PERM filing steps. It’s important to note that PERM can be filed at least 60 days from the job posting date or 30 days from the last advertisement. We filed the prevailing wage request on August 24, 2022. After obtaining the Prevailing Wage Determination, the Petitioner filed the job order on July 24, 2023. We then promptly filed the PERM application on October 26, 2023. Eventually, on April 9, 2025, the PERM Labor Certification for an EB-2 position for the Canadian beneficiary was approved.
Once the PERM was certified, our client retained our office for his I-140 petition. We filed the I-140 application via premium processing on May 15, 2025. We included the job offer letter and other necessary supporting documents. The I-140 was approved on May 29, 2025. Once his priority date becomes current, he will be able to file his I-485 adjustment of status application.
