CASE: I-485 Adjustment of Status / I-140 (EB-2 Category) / Schedule A
APPLICANT: Canadian Nurse Practitioner
Our client, a certified mental health nurse practitioner, had an employer willing to sponsor him for an I-140 petition. He qualified for “Schedule A” classification due to his master’s degree in nursing and his certification as a Nurse Practitioner.
Our firm was retained on February 12, 2022, and we promptly filed the Prevailing Wage Determination. Subsequently, we filed the I-140 application on April 20, 2023, via premium processing. The submission included the job offer letter, the notice of filing, and all other required documentation. In our cover brief, we detailed the “ability to pay” argument and provided justification for nurse practitioners’ inclusion under the Schedule A designation. On April 28, 2023, USCIS approved the EB-2 I-140 petition without issuing a Request for Evidence (RFE).
Following the I-140 petition’s approval, our client re-engaged our firm for his I-485 application. We filed the I-485 on October 3, 2024. On July 1, 2025, USCIS approved our client’s adjustment of status application, and he is now a green card holder.
