EB-3 Green Card Approval for Filipino Secondary Physical Education Teacher in Rio Rancho New Mexico

APPLICANT: Filipino Secondary Physical Education Teacher

LOCATION: Rio Rancho, NM

 

Our client has a current employer willing to petition him for a third-preference employment-based (EB-3) visa. Our client holds a Bachelor’s degree in Physical Education, a valid New Mexico teaching license, and has worked for his current employer since January 2022. Based on his educational and professional background, our office determined he was clearly eligible for EB-3 classification. Our client officially retained our services in May 2022.

 

Prior to filing the PERM, our firm prepared the prevailing wage request, job order, advertisements, internal job posting, recruitment report, and all other essential pre-filing steps. Please note that a PERM application must be filed at least 60 days after the job posting date and 30 days after the final advertisement. We filed the prevailing wage request within a week of being retained. After obtaining the determination, the employer filed the job order on January 23, 2023. On April 6, 2023, we filed the PERM application, which was approved without an audit on May 6, 2024, for the Filipino beneficiary.

 

Once the PERM was certified, our client retained us for his I-140 petition. We filed the application on May 20, 2024, via premium processing, including the job offer letter, the notice of filing, and all necessary supporting documents. The I-140 was approved shortly after on May 29, 2024.

 

Our client’s priority date became current in October 2025. Consequently, he retained our office to file I-485 Adjustment of Status applications for himself and his immediate family members on October 7, 2025. The process proceeded smoothly, with receipt notices and fingerprint appointments arriving on schedule. On January 14, 2026, USCIS approved the adjustment of status applications. Our client and his family are now proud lawful permanent residents of the United States.
