EB-3 I-140 Approval for Filipina Elementary School Teacher Beneficiary and Public School District Petitioner in New Town, North Dakota

Our client‘s current employer is willing to petition for her under a third-preference petition (I-140). She holds a Bachelor’s degree in Elementary Education, a valid North Dakota Teaching license, and has been employed by her current employer since August 2019. Based on her educational, professional, and work background, our office determined she is clearly eligible for EB-3 classification for the I-140 petition. Our client officially retained us in May 2023.

 

Prior to filing the PERM application, our firm prepared the prevailing wage request, job order, advertisements, internal job posting, recruitment report, and all other necessary pre-PERM filing steps. The PERM application could be filed at least 60 days from the job posting date or 30 days from the last advertisement.

 

Within a week of our retention, the prevailing wage request was filed. After receiving the prevailing wage determination, her employer filed the job order on January 5, 2024. We promptly filed the PERM application on April 18, 2024.

 

Eventually, on August 26, 2025, the PERM Labor Certification for an EB-3 position for the Filipina beneficiary was approved without any audit.

 

Once the PERM was certified, our client retained our office for her I-140 petition. We filed the I-140 application via premium processing on September 18, 2025. We included the job offer letter, a letter demonstrating the employer’s financial ability to pay, and other necessary supporting documents.

 

Eventually, on October 6, 2025, the I-140 was approved without a Request for Evidence (RFE). Once her priority date becomes current, she can file her I-485 Adjustment of Status application.
