Our client is an Egyptian national currently working in the United States as an associate periodontist on an H-1B visa. Her current employer is willing to sponsor her for a second-preference (EB-2) immigrant petition. Our client is highly qualified: she holds a dentistry degree from Egypt, which has been evaluated as the equivalent of a U.S. Doctor of Dental Medicine (D.D.M.) degree. She also possesses a license to practice dentistry in the state of Texas and has completed three years of residency training in periodontics. Based on her educational, professional, and working backgrounds, our firm concluded that her employer can successfully petition her as an associate periodontist, and she is clearly eligible for EB-2 classification.
Prior to filing the PERM application, our firm prepared and completed all necessary pre-filing steps, including the prevailing wage request, job order, advertisements, internal job posting, and the recruitment report. We note that PERM can be filed at least 60 days from the job posting date or 30 days from the last advertisement. The Prevailing Wage Request was initially filed on September 26, 2023. After obtaining the required determination, the employer filed the job order on March 18, 2024. We promptly filed the PERM application on July 1, 2024. The PERM Labor Certification for the EB-2 position was eventually approved on November 4, 2025. The client can now proceed with filing the I-140 immigrant petition.
