Our client‘s current employer is willing to petition for her with a third-preference I-140 petition. She holds a bachelor’s degree in High School ESL Teaching, a valid South Dakota Teaching license, and has been with her current employer since February 2022. Based on her educational and professional background, our office determined that she is clearly eligible for EB-3 classification for the I-140 petition. Our client retained us in May 2023.
Before filing PERM, our firm handled all pre-filing steps, including preparing the prevailing wage request, job order, advertisements, internal job posting, and recruitment report. The PERM application could be filed at least 60 days from the job posting date or 30 days from the last advertisement. We filed the prevailing wage request within one week of being retained. After receiving the prevailing wage determination, her employer filed the job order on January 5, 2024. We promptly filed PERM on April 18, 2024.
The PERM Labor Certification for the EB-3 position was approved without an audit on August 12, 2025. Our client can now file the I-140 petition at any time.
