CASE: H-1B Visa Extension Petition

BENEFICIARY: Filipino Elementary School Teacher
Our client is a Public School District in Saint Francis, SD. They contacted our office in July 2022 to seek legal assistance from our office for their foreign employee’s H-1B extension. The beneficiary obtained his Bachelor’s Degree in Elementary Education. The proffered position for the Beneficiary is an Elementary School Teacher which qualifies as a specialty occupation. This proffered position is clearly a “specialty occupation” because the minimum requirement for this position is a Bachelor’s Degree in Education or its equivalent. The Beneficiary has worked for his employer under H-1B status since October 2021.
Upon retention, our office filed the H-1B visa petition with various supporting documents on August 16, 2022 via premium processing. Our client’s H-1B application was approved on August 25, 2022 without any RFE. His H-1B is good until October 27, 2025.
