I-751 Conversion from Joint to Waiver Approved for Indian Client in Youngstown Ohio

Our client contacted our office in September of 2021 regarding his I-751 application.

He is from India and he married a U.S. citizen in April 2018. He obtained a 2-year conditional green card in November 2019. His conditional residency was terminated in November 2021. To comply with immigration requirements, our client and his wife had to file an I-751 Joint Petition to Remove Conditions. He retained our office on September 20, 2021, and on October 12, 2021, our office filed the I-751 application to the USCIS.

However, in May 2023, our client and his wife finalized their divorce. On May 22, 2023, our office prepared and filed an I-751 conversion request to the USCIS and asked the USCIS to convert our client’s I-751 application from joint filing to a waiver of joint filing (due to the divorce.) On July 29, 2023, the USCIS approved our client’s I-751 application without any Request for Evidence (RFE). He received his 10-year green card.
