CASE: H-1B Visa Extension Petition
PETITIONER: Public School District in Saint Francis, SD
BENEFICIARY: Filipino Secondary School Teacher
Our client is a public school district in Saint Francis, SD. In September 2025, they contacted our office to seek legal assistance for their foreign employee’s H-1B extension. The beneficiary obtained her Bachelor’s Degree in Secondary Education. The proffered position is a Secondary School Teacher, which qualifies as a specialty occupation. This position meets the definition of a ‘specialty occupation’ because the minimum requirement is a Bachelor’s Degree in Education or its equivalent. The beneficiary has worked for the employer under H-1B status since December 2021.
Once retained, our office promptly filed the H-1B visa petition with supporting documents on November 20, 2025, via regular processing. On May 14, 2026, we filed a Form I-907 premium processing upgrade request with USCIS. Ultimately, the client’s H-1B petition was approved on June 3, 2026, without a Request for Evidence (RFE).
