EB-3 I-140 Approval for Filipina Kindergarten Teacher Beneficiary and Public School District Petitioner in Porcupine South Dakota

CASE: EB-3 I-140

EMPLOYER: Public School District

BENEFICIARY: Filipina Kindergarten Teacher

LOCATION: Porcupine, SD

Our client’s current employer was willing to petition her for an EB-3 employment-based immigrant visa (Form I-140). Our client holds a Bachelor’s degree in Elementary Education, possesses a valid South Dakota teaching license, and has been employed with her current sponsor since May 2023. Based on her educational, professional, and work background, our office determined that she was clearly eligible for EB-3 classification. She officially retained our firm in June 2024.

Prior to filing the PERM application, our firm prepared the prevailing wage request, job order, advertisements, notice of filing/internal job posting, recruitment report, and all other mandatory pre-filing steps—ensuring compliance with all mandatory waiting periods (such as waiting at least 30 days following the end of the recruitment period and filing within 180 days). Within a week of being retained, we submitted the Prevailing Wage Determination (PWD) request. After obtaining the PWD, the employer placed the job order on March 13, 2025. On August 20, 2025, we filed the PERM application. On August 3, 2026, the PERM Labor Certification was approved without an audit for an EB-3 position on behalf of the beneficiary.

Following PERM certification, our client retained our office to prepare and file her Form I-140 petition. We submitted the I-140 via Premium Processing on September 17, 2026, and on October 14, 2026, the petition was approved without a Request for Evidence (RFE). Once her priority date becomes current, she will be eligible to file her Form I-485 Application to Register Permanent Residence or Adjust Status.
