CASE: EB-3 I-140
EMPLOYER: Public School District
BENEFICIARY: Filipina High School Social Studies Teacher
LOCATION: Lame Deer, MT
Our client’s employer agreed to petition her for an Employment-Based Third Preference (EB-3) immigrant visa. She holds a Bachelor’s degree in Secondary Education, a valid Montana teaching license, and has worked for her employer since August 2023. Based on her strong educational and professional background, our office determined she was clearly eligible for EB-3 classification, and she retained our firm in September 2024.
Prior to filing the PERM Labor Certification, our firm completed all requisite pre-filing recruitment steps, including the prevailing wage request (PWR), job order, newspaper advertisements, internal notice posting, and recruitment report. Per regulations, a PERM application must be filed between 30 and 180 days after the final recruitment step. Within a week of being retained, we submitted the PWR. Following receipt of the prevailing wage determination, the employer filed the job order on April 9, 2025. We subsequently filed the PERM application on August 18, 2025. On July 24, 2026, the PERM Labor Certification was approved without an audit for the Filipina beneficiary.
Following PERM certification, the client retained us for the Form I-140 Immigrant Petition for Alien Worker. We filed the I-140 petition with Premium Processing on September 17, 2026. On October 10, 2026, the I-140 was approved without a Request for Evidence (RFE). She will be eligible to file her Form I-485 Application to Register Permanent Residence or Adjust Status once her priority date becomes current.
