EB-3 I-140 Approval for Filipina High School Special Education Teacher Beneficiary and Public School District Petitioner in Lame Deer Montana

CASE: EB-3 I-140

EMPLOYER: Public School District

BENEFICIARY: Filipina High School Special Education Teacher

LOCATION: Lame Deer, MT

Our client’s current employer was willing to petition her for an Employment-Based Third Preference (EB-3) I-140 petition. She holds a Bachelor’s degree in Special Education, possesses a valid Montana teaching license, and has been employed with her sponsor since September 2023. Based on her educational credentials and professional experience, our office determined that she clearly qualified for EB-3 classification. She retained our services in September 2024.

Prior to filing the PERM application, our firm completed all necessary pre-filing recruitment steps, including the prevailing wage request, job order, advertisements, notice of filing, and recruitment report. Note that a PERM application may be filed at least 60 days after the job posting date or 30 days after the final advertisement. Within a week of being retained, we filed the prevailing wage request. After receiving the determination, the employer placed the job order on April 8, 2025. We filed the PERM application on August 14, 2025. On July 24, 2026, the PERM labor certification was approved without an audit for an EB-3 position on behalf of our beneficiary from the Philippines.

Following labor certification, the client retained our firm for her I-140 petition. We submitted the I-140 under premium processing on September 17, 2026. On October 13, 2026, the I-140 petition was approved without a Request for Evidence (RFE). Once her priority date becomes current, she will be eligible to file her Form I-485 application for adjustment of status.
