CASE: EB-3 I-140
EMPLOYER: Public School District
BENEFICIARY: Filipino Junior High Social Studies Teacher
LOCATION: Lame Deer, MT
Our client’s employer agreed to petition him for an EB-3 classification (I-140). With a Bachelor’s degree in Secondary Education, a valid Montana teaching license, and continuous employment with his sponsor since August 2023, our office determined that he was fully qualified for the position. The client officially retained us in September 2024.
Prior to filing the PERM labor certification, our firm prepared and completed all necessary pre-filing recruitment steps, including the prevailing wage request (PWR), job order, advertisements, notice of filing, and recruitment report—ensuring strict compliance with the mandatory recruitment timeframes. We submitted the PWR within a week of being retained. After receiving the prevailing wage determination, the employer filed the job order on April 11, 2025. We then filed the PERM application on August 21, 2025. On July 24, 2026, the PERM application was approved without an audit for the beneficiary, a native of the Philippines.
Following PERM certification, the client retained our firm for his I-140 Immigrant Petition. We filed the petition with Premium Processing on September 17, 2026, and received approval without a Request for Evidence (RFE) on October 13, 2026. Once his priority date becomes current, he will be eligible to file his Form I-485 Application to Register Permanent Residence or Adjust Status.
