BENEFICIARY: Filipino Third Grade Elementary Teacher

Our client’s current employer is willing to sponsor him for a third-preference (EB-3) immigrant visa petition (I-140). Our client holds a Bachelor’s degree in Elementary Education and a valid South Dakota teaching license, and has been employed with his current sponsor since February 2022. Based on his educational and professional background, our office determined that he clearly qualifies for EB-3 classification. The client formally retained our services in February 2024.
Prior to filing the PERM Labor Certification, our firm managed all essential pre-filing requirements, including the prevailing wage request, job order, advertisements, internal job postings, and the recruitment report. (Please note that a PERM application may be filed no sooner than 60 days after the job order is posted and 30 days after the final advertisement). We filed the prevailing wage request within one week of being retained. Following the prevailing wage determination, the employer filed the job order on August 26, 2024, and we promptly submitted the PERM application on November 14, 2024.
On March 25, 2026, the PERM Labor Certification was approved without an audit for an EB-3 position. Our client is now eligible to file the I-140 petition at any time.
