Our client, a Canadian citizen, is currently working in the United States as an oral and maxillofacial surgeon under H-1B status. His employer agreed to sponsor him for an employment-based, second-preference (EB-2) immigrant petition. The client holds a Doctor of Dental Medicine (DMD) degree and completed a four-year residency in oral and maxillofacial surgery, both in the United States. Based on his extensive educational and professional background, our firm concluded that his employer could successfully petition for him as an Oral and Maxillofacial Surgeon, as he clearly meets the eligibility requirements for the EB-2 classification.

 

Prior to filing the PERM labor certification, our firm handled all essential pre-filing steps, including preparing the prevailing wage request, job order, advertisements, internal job posting, and recruitment report. (Please note that a PERM application can only be filed at least 60 days after the job posting date and 30 days after the last advertisement). We filed the prevailing wage request on August 24, 2022. After receiving the prevailing wage determination, the petitioner filed the job order on July 24, 2023. We then promptly filed the PERM application on October 26, 2023. The PERM Labor Certification for this EB-2 position was ultimately approved on April 9, 2025.

 

Following the PERM certification, the client retained our office to file his I-140 immigrant petition. We submitted the I-140 application via premium processing on May 15, 2025, alongside the job offer letter and all necessary supporting documentation. The I-140 petition was approved shortly thereafter, on May 29, 2025.

 

The client’s priority date became current in October 2025. He retained our services once more, and we filed his I-485 Adjustment of Status application on October 24, 2025. The process moved forward smoothly, with receipt notices and fingerprint appointments arriving on schedule. On May 17, 2026, USCIS approved the adjustment of status application, and our client is now a lawful permanent resident.
