Our client’s employer sought to sponsor her for a employment-based third-preference (EB-3) immigrant visa petition (Form I-140). Holding a Bachelor’s degree in Secondary Education and a valid Arkansas teaching license, she had been working for the employer since March 2023. Based on her educational background and professional experience, our office determined she was clearly eligible for EB-3 classification, and she retained our firm in April 2024.
To prepare for the PERM Labor Certification filing, our firm completed all necessary pre-filing recruitment steps, including the prevailing wage request (PWR), job order, advertisements, internal job posting, and recruitment report. Within a week of being retained, we submitted the PWR. Following the prevailing wage determination, the employer placed the job order on January 22, 2025. On June 2, 2025, we filed the PERM application, which was approved without an audit on June 23, 2026, certifying the EB-3 position for our beneficiary.
Following PERM certification, the client retained us to file her Form I-140 petition. We submitted the application via Premium Processing on August 20, 2026, and it was approved without a Request for Evidence (RFE) on September 9, 2026. She will be eligible to file her Form I-485 Application to Register Permanent Residence or Adjust Status once her priority date becomes current.
