CASE: EB-3 I-140
EMPLOYER: Public School District
BENEFICIARY: Filipino 5th Teacher
LOCATION: Porcupine, SD
Our client’s employer was willing to petition him under the Employment-Based Third Preference (EB-3) category. Holding a Bachelor’s degree in Secondary Education and a valid South Dakota teaching license, and having worked for his employer since May 2023, our client clearly met the requirements for EB-3 classification. Consequently, he retained our firm in June 2024 to initiate the green card process.
Prior to filing the PERM labor certification, our firm prepared and completed all required pre-filing recruitment steps, including the prevailing wage request (PWR), state job order, print advertisements, internal job posting, and recruitment report. Within one week of being retained, we filed the PWR. Following receipt of the prevailing wage determination, the employer placed the job order on March 13, 2025. Upon completing the mandatory recruitment and waiting periods (at least 60 days from the job order and 30 days from the final advertisement), we filed the PERM application on August 19, 2025. On August 3, 2026, the PERM application was approved without an audit.
Following PERM certification, our client retained our office for the Form I-140 petition. We filed the I-140 petition with Premium Processing on September 17, 2026, and USCIS approved the petition on October 14, 2026, without a Request for Evidence (RFE). Once our client’s priority date becomes current, he will be eligible to file his Form I-485 Application to Register Permanent Residence or Adjust Status.
