Our client’s employer is willing to petition for her under the employment-based third preference (EB-3 / Form I-140). She holds a Bachelor’s degree, possesses a valid South Dakota teaching license, and has been employed with her current employer since August 2023. Based on her educational, professional, and work background, our office determined that she is clearly eligible for EB-3 classification. She retained our firm in December 2024.
Prior to filing the PERM application, our firm prepared the prevailing wage request, job order, advertisements, internal job posting, recruitment report, and all other essential pre-PERM filing requirements. (Note that a PERM application may be filed no sooner than 60 days from the start of the job posting or 30 days following the last advertisement.) Within a week of our retention, we filed the prevailing wage request. After receiving the determination, the employer filed the job order on June 4, 2025. On November 11, 2025, we promptly submitted the PERM application.
On September 28, 2026, the PERM Labor Certification was approved without an audit for an EB-3 position on behalf of the Filipina beneficiary. Our client is now eligible to file the I-140 petition at any time.
