CASE: I-751 / Waiver of the Joint Waiver Requirement

Our client contacted our office in May 2018 regarding her potential I-751 filing. She is from Lebanon and she married a U.S. citizen in February 2016. Through her marriage with a U.S. citizen spouse, she obtained a 2-year conditional green card in July 2016. Therefore, her conditional residency was good until July 2018.
Unfortunately, during their marriage, our client and her ex-husband went through struggles, one of them being the subject of extreme cruelty by her ex-husband. They lived separately for a while and their divorce was finalized, however, due to this, our client could not file an I-751 application jointly with her ex-husband. We advised that we can help her file the I-751 application with a waiver of the joint filing requirement. We requested a waiver because our client entered the marriage in good faith, but the marriage was terminated through divorce or annulment before they could file a joint petition.
On June 28, 2018, our office filed the I-751 application with various supporting documents to demonstrate our client’s bona fide marriage with her ex-husband.
In August 2019, the USCIS a Request for Evidence (RFE) and asked our client to submit more authentic marital evidence against her ex-husband. Our office prepared the Response to RFE on November 1, 2019.
In February 2023, the USCIS scheduled an I-751 interview for our client. Before the interview, our office thoroughly prepared our client with potential issues at the interview. On March 30, 2023, our client was interviewed for her I-751 application at the USCIS Detroit, MI Field Office. The USCIS approved her I-751 application on April 6, 2023. Now, she has her ten-year green card.
