CASE: H-1B Visa Extension Petition
PETITIONER: Public School District in Porcupine, SD
BENEFICIARY: Filipino 5th Grade Teacher
Our client is a public school district in Porcupine, SD. They contacted our office in September 2025 seeking legal assistance for their foreign employee’s H-1B extension. The beneficiary holds a Bachelor’s Degree in Elementary Education, and the offered position—5th Grade Teacher—qualifies as a specialty occupation, as it requires at least a bachelor’s degree in education or a related field. The beneficiary has been employed in H-1B status with the school district since May 2023.
Once retained, our office promptly filed the H-1B petition with supporting documentation on December 8, 2025, via regular processing. On September 3, 2026, we submitted a Form I-907 Premium Processing upgrade request to USCIS. On September 17, 2026, USCIS approved the H-1B petition without issuing a Request for Evidence (RFE).
