Our client worked as an Engineering Manager and his employer was willing to petition him for an I-140 petition. Our client has a Master of Science degree in Industrial Engineering and several years of experience as an engineering manager. After talking to our client, our firm concluded that his employer can petition him as an Engineering Manager and he is eligible for EB-2 classification. They retained us on October 14, 2024.
Before filing PERM, our firm prepared the prevailing wage request, job order, and all other steps which are important to pre-PERM filing. Within a week from retention, the prevailing wage request was filed. After obtaining the prevailing wage determination, the petitioner filed the job order on April 7, 2025. On June 25, 2025, we filed PERM. On July 8, 2026, the PERM Labor Certification was approved – an EB2 position for the Korean beneficiary.
We then proceeded with the I-140 Petition filing. We submitted the “ability to pay” letter for the I-140 petition. We also included the job offer letter, employer’s tax records, and other supporting documents. The I-140 was filed on August 3, 2026 via premium processing service. On August 26, 2026, the I-140 EB2 Petition for our Korean client was approved. He can file an I-485 application for his green card at any time.
