Our client’s current employer was willing to petition him for a third-preference (EB-3) visa. With a Bachelor’s degree in Psychology, a valid South Dakota Teaching license in School Counseling, and a solid history with his employer, our office determined he was clearly eligible for EB-3 classification. The client retained our services in April 2022.
Prior to filing the PERM, our firm prepared the prevailing wage request, job order, advertisements, internal job posting, and recruitment report. Within a week of being retained, we filed the prevailing wage request. After obtaining the determination, the employer filed the job order on March 2, 2023, and we promptly filed the PERM application on June 29, 2023. On August 15, 2024, the PERM Labor Certification was approved without an audit for this EB-3 position.
Once the PERM was certified, the client retained us for the I-140 petition, which we filed via premium processing on December 16, 2024. We included the job offer letter, notice of filing, and all necessary supporting documentation. The I-140 was approved on July 4, 2025.
The client’s priority date became current in January 2026. We subsequently filed I-485 Adjustment of Status applications for the client and his wife on January 20, 2026. The process proceeded smoothly, with receipt notices and fingerprint appointments arriving promptly. On March 29, 2026, USCIS approved the applications, and our client and his wife are now Lawful Permanent Residents.
